The Civil Process Division is responsible for:

  • Service of Civil Process.
    • Subpoenas
    • Orders of Protections
    • Summons/Other
  • Enforcement of Court Orders
    • Forcible Entry and Detainer (Evictions)

  • Orders of Replevins

EVICTIONS (FORCIBLE ENTRY AND DETAINER)

  • The Peoria County Sheriff’s Office cannot provide legal advice or make any recommendations for service providers (locksmiths, movers, etc.)
  • Must have two certified copies of the Court Order for each defendant being served
  • Must have exact address to include Apartment, Suite, and direction (N,S,E,W) if applicable
    • Incorrect or incomplete addresses will prevent the enforcement of the Court Order
    • The Peoria County Sheriff’s Office can only enforce the Court Order upon the named parties within the Court Order. 
  • Evictions are scheduled as follows:
    • Can only be scheduled after the enforceable date listed on the Court Order
    • Scheduled into available openings on the Eviction Calendar
      • Tuesday, Wednesday, Thursday
        • 9:00 AM or 1:00 PM 
  • $50 Deposit due at the time of scheduling
  • Request for scheduling outside the above availability will require fees for Expedited Service and only scheduled if approved by Civil Process Administrator.

 

Plaintiff/Landlord Requirements

  • Plaintiff or their agent must be present at the site during the entire eviction process
  • Must supply a minimum of three (3) able-bodied movers
  • Plaintiff/Landlord will be required to move all personal belongings of the Defendant (Tenant) to a public right of way.
  • Mobile Homes, Trailers, and vehicles that are not movable must be removed.
    • If a vehicle is inoperable, it must be towed.
    • If placement of an item on the public right of way would create a public safety hazard, other arrangements must be made for the removed property.
      • Any hazards need to brought to the attention of the Peoria County Sheriff’s Officer.  Examples (Guns, Alcohol, Medication, Appliances with doors)
      • The Peoria County Sheriff’s Officer will direct the Plaintiff/Landlord as to the placement of removed property.
        • The Peoria County Sheriff’s Office will not allow damage to property during the moving of possessions.
        • The Peoria County Sheriff’s Officer will remain on site until all property has been moved to the right of way
      • A locksmith or maintenance person must be present to change locks
      • Plastic bags and/or plastic will be needed to protect property during inclement weather
      • The Defendant’s property must remain undisturbed by the Plaintiff for 24 hrs.
        • After 24 hrs it is the responsibility of the plaintiff to remove all items remaining at the site.

 

Cancellations/Postponement

  • The Sheriff’s Office is the only entity that can postpone an eviction.
  • You must contact the Peoria County Sheriff’s Office Civil Process Office (309-672-6040) to cancel an eviction
    • Cancelling of a scheduled eviction by a Plaintiff will result in a charge for the processing of the Forcible Entry and Detainer and may require an additional Order by the Court for enforcement.

Eviction Fees

  • $15.00 for Service
  • $5.00 for Return
  • $1.00 per mile
  • $43.30 per hour per officer.
    • When an eviction extends beyond the normal workday of the officer, the hourly rate of $43.30 will increase by the contractual rate for the officer.
    • Cancellation of an eviction will result in the standard Service and Return Fee.
